IN NO EVENT ARE LUXSTATEOFMIND LLC, ITS OFFICERS OR EMPLOYEES LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES OF ANY KIND, OR ANY OTHER DAMAGES TO PERSON OR PROPERTY  WHATSOEVER, INCLUDING, WITHOUT LIMITATION, MEDICAL, LOST WAGES, DAMAGES RESULTING FROM LOSS OF PROFIT, LOSS OF CONTRACTS, LOSS OF REPUTATION, GOODWILL, DATA, INFORMATION, INCOME, ANTICIPATED SAVINGS OR BUSINESS RELATIONSHIPS, WHETHER OR NOT LUXSTATEOFMIND LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE, ARISING OUT OF OR IN CONNECTION WITH THE USE OF OUR SERVICES OR THIS WEBSITE, EXCEPT FOR PERSONAL INJURY OR DEATH OF A PERSON CAUSED BY THE GROSS NEGLIGENCE OF LUXSTATEOFMIND. 

IN ANY EVENT, TO THE FULLEST EXTENT PERMITTED BY LAW, AND NOTWITHSTANDING ANY OTHER PROVISION OF THIS AGREEMENT, THE TOTAL LIABILITY OF LUXSTATEOFMIND LLC, ITS OFFICERS AND EMPLOYEES FOR ANY AND ALL CLAIMS, LOSSES, COSTS OR DAMAGES, INCLUDING ATTORNEYS’ FEES AND COSTS SHALL NOT EXCEED THE TOTAL AMOUNT OF THE SERVICE PRICE, IF ANY.

Exceptions

Nothing in this Agreement notice limits or excludes liability for anything for which it would be unlawful for us to exclude.

Age verification

You must be 21+ to purchase our products from the Website, as well as to enter contracts with us. For verification, we use a third party company called https://agechecker.net/. You will need to upload a selfie and driver’s license. We will not complete a purchase or ship your package without approval from the third party verification company or manual verification, which may be done by sending us an email with a selfie of yourself and your ID. Please send it to hello@bobobotanicals.com.

By making a purchase at the Website or submitting a form to us, you understand that you must be age verified.  If you are denied, or choose to not being age verified, we will not refund your money. We will only refund money if you have an issue with our products. If you do not feel comfortable being age verified over https://agechecker.net/or verified at all, please do not purchase from our company. 

Risk of Loss

All items purchased from us are made pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery to the carrier. 

Shipping & Payment​

​Shipment processing time. All orders are processed within 2-5 business days. Orders are not shipped on weekends or holidays.

If we are experiencing a high volume of orders, shipments may be delayed by a few days. Please allow additional days in transit for delivery. If there is a significant delay in the shipment of your order, we will contact you via email or telephone. Shipping charges for your order will be calculated and displayed at checkout. ​

Estimated delivery time. 2-5 business days

Shipment to P.O. boxes or APO/FPO addresses. We ship to addresses within the U.S., U.S. Territories, and APO/FPO/DPO addresses.

​Shipment Confirmation & Order Tracking. You will receive a Shipment Confirmation email once your order has shipped containing your tracking number(s). The tracking number will be active within 24 hours.

Customs, Duties and Taxes. We are not responsible for any customs and taxes applied to your order. All fees imposed during or after shipping are the responsibility of the customer, including tariffs, taxes, etc.

​Damages. We are not liable for any products damaged or lost during shipping. If you received your order damaged, please contact the shipment carrier to file a claim. Please save all packaging materials and damaged goods before filing a claim.

​International Shipping Policy. We currently do not ship outside the U.S.

Return Policy 

We offer a 15 day exchange policy on tinctures, concentrates, edibles and topicals if they are defective or damaged. Our customer service team has discretion in taking returns on products provided it was 30 days from purchase. If the product was mostly fully used, we will not accept return or exchange.
